Biography:

Preston Pugh is a Partner in Pugh, Jones, Johnson & Quandt's Litigation Practice Group.  His expertise includes healthcare litigation, complex civil litigation, internal investigations, and labor and employment litigation.  Prior to joining the Firm, he was GE Healthcare's Senior Counsel for Investigations and Litigation, where he was responsible for domestic and international fraud and abuse investigations for the $17B business, and its commercial litigation practice.


Experience:

Mr. Pugh is nationally recognized for his hands-on expertise with domestic antikickback laws and the FCPA--having been frequently invited to speak to private industry on issues arising in those areas.  He has personally conducted investigations in numerous parts of the United States, Europe, Asia and South America, involving issues such as healthcare fraud and abuse law, the False Claims Act, the FCPA, government procurement fraud, accounting fraud, FDA violations, antikickback violations, employment harassment and discrimination, certain antitrust violations, and environmental health and safety laws. 

As a former Assistant United States Attorney in Chicago, Mr. Pugh led investigations of False Claims Act violations, including qui tam cases, and tried a number of civil cases.  For his work there, he received several Civil Division commendations. In 2004, he was recognized as one of Illinois "Top 40 Under 40 Attorneys to Watch."

Mr. Pugh is also well-versed in labor and employment law.  As a member of the Northern District of Illinois' Trial Bar, he has tried several federal cases to conclusion (both bench and jury) in employment discrimination, trade secrets and noncompetition law.  As a partner in private practice, he was part of a team that handled ERISA issues in the United Airlines bankruptcy case, and he also defended a Fortune 150 company in a seminal pattern and practice claim brought by the OFCCP.  He has served as Appellate Counsel at the National Labor Relations Board in Washington, D.C., where he successfully briefed and argued cases in most of the federal courts of appeals.  He has also served as Chair of the Labor and Employment Section of the Chicago Bar Association.

Mr. Pugh has been part of the national faculty of the National Institute for Trial Advocacy for many years.  He has also taught appellate advocacy as an adjunct law professor at Loyola University Chicago School of Law.  He is a member of the American Bar Association's Health Law Section, the Illinois Association of Healthcare Attorneys, and the Chicago Council on Global Affairs.  Mr. Pugh is also a member of the Development Board at Advocate South Suburban Hospital, and a past member of the Illinois Attorney Registration and Disciplinary Commission.
